Inspired by the news of a Biden aide who invoked  the Fifth Amendment in a House panel's investigation into the former President's mental fitness and the use of the presidential autopen while in office.

The painting is a play on both the Fifth Amendment’s right to remain silent and the notion of a “fifth” of liquor.
